Eligbility
The L-1 visa was originally created to give companies with locations in multiple countries the ability to transfer employees from one location to another. For this reason, the L-1 visa is also known as an “intracompany transferee” visa.
Based on this historical context, the first eligibility requirement of an L-1 visa is that there be at least two active companies involved in the application process, one of them being in the United States. The foreign company must have been in existence for at least one year prior to the filing of the L-1 visa application. The U.S. company, on the other hand, can either be pre-existing, or it can be created for the purpose of establishing L-1 visa eligibility.
The second eligibility requirement is that the individual applying for L-1 visa status be either an executive, a manager, or and individual who possesses specialized knowledge of the company’s operations.
Benefits
A key benefit of the L-1 visa is that no minimum investment amount in a U.S. business is required. In addition, the immediate family members of the principal L-1 applicant are also eligible for L visa status. The spouse of the principal applicant is eligible for full U.S. work authorization, and children are eligible to attend school.
Lastly, once in L-1 status, an applicant may apply for U.S. permanent residency for themselves and for their immediate family members if they desire to do so. They are then also eligible for U.S. citizenship.
