The EB-1A visa, also known as the Extraordinary Ability visa, is a U.S. permanent residency visa designed to attract individuals who possess extraordinary ability in athletics, business, the arts, sciences or education. 

 Eligibility

The EB-1A visa is competitive and requires substantial evidence to demonstrate that the applicant is at the top of their field.  Accomplishments should reflect a sustained level of acclaim, and should demonstrate that the applicant has had a significant impact in their field.

Evidence to demonstrate extraordinary ability may include:

  • Receipt of awards or prizes of national or international significance
  • Membership in associations requiring outstanding achievements
  • Published material about the applicant’s work
  • Original contributions of major significance to the field
  • A high salary or remuneration compared to others in the field

The EB-1A visa offers a direct pathway to U.S. permanent residency.  The application process is also faster than for many other visa categories.  Additionally, EB-1A applicants may self-petition.  This means that neither a job offer nor any other type of U.S. sponsorship is required.

Once an EB-1A application is approved, the applicant enjoys all of the rights and privileges of U.S. permanent residency.  Immediately family members may also obtain permanent residency along with the principal applicant.  All are also eligible for U.S. citizenship.
